Undue Influence

As James Munby firmly stated, â€Å"it is impossible to define, and difficult even to describe, at what point at which the influence becomes, in the eye of law, undue. † The doctrine of undue influence has been agreed upon as â€Å"the ground of relief developed by the courts of equity as a court of conscience. † It is an ordinary behaviour to influence individuals and persuade them to enter into transactions. However, the aim is to ensure that the influence exercised is not abused.On the grounds of these concepts, it is impossible to set a flawless higher definitive criterion to be directly applied in every case to recognize whether undue influence had been exercised or not. Attempting to do that has been problematic. Firstly, courts have not been able to always distinguish between undue influence and unconscionability dealing. Secondly, titles categorizing undue influence as either â€Å"claimant-sided† or â€Å"defendant-sided† have not been successful in presenting undue influence as an independent doctrine.Thirdly, subdividing undue influence into categories and setting rules under them increased the possibility of misconceptions arising. Since undue influence is an equitable doctrine, the criteria set to define it ought to only provide a framework for judges to exercise their jurisdiction. Hence, it allows them to assess cases flexibly based on the particulate facts provided rather than looking at undue influence as a common law doctrine and applying the rules set strictly.A main difficulty in attempting to set a comprehensive definitive description of undue influence is its numerous resemblances with the unconscionability notion. The usage of the word â€Å"unconscionable† in describing undue influence has established an opinion that it is based on the Unconscionability Bargains doctrine. Furthermore, misconception can be recognized in the case Lloyds Bank Plc v Lucken, where Mr. Lucken had pressured Mrs. Lucken to obta in a loan using her house’s security. Mrs. Lucken ultimately agreed to Mr. Lucken’s request, and the money was lent to one of Mr.Lucken's eventually failing businesses. She later claimed that the charge was impeachable because Mr. Lucken had exercised undue influence upon her. The Court of Appeal refused relief disputing that the pressure placed was not â€Å"unconscionable. † Tending to define undue influence in an excessive precise manner using the word â€Å"unconscionable† has rather caused confusion and difficulty in terms of separating it from unconscionability dealing. Therefore, even if the two doctrines share similarities, they should still be distinguished.Undue Influence is concerned with â€Å"the quality of the consent or assent of the weaker party,† while unconscionable dealing is concerned with â€Å"the conduct of the stronger party in attempting to enforce, or retain the benefit of, a dealing with a person under a special disabili ty in circumstances where it is not consistent with equity. † Legal certainty requires that they be distinct; hence there should not be an attempt to limit undue influence under a precise definition unless it would be used to represent and clarify that it is an independent doctrine.There has been an ongoing debate on whether undue influence is categorized as a â€Å"claimant-oriented† or â€Å"defendant-oriented† doctrine. The defendant approach suggests that it is â€Å"illegitimate† or â€Å"unconscionable. † As Lord Hoffman stated in R v Attorney-General for England and Wales, â€Å"undue influence has concentrated in particular upon the unfair exploitation by one party of a relationship which gives him ascendancy or intense over the other. † Including â€Å"unacceptable means† and â€Å"unfair exploitation† within the definition makes it powerfully appear as defendant focused.Furthermore, claimant-sided orientation defines t he influence as being â€Å"overbearing† and â€Å"too high. † It originally aimed to differentiate unconscionability from undue influence, but rather obliquely connected it to another doctrine. It was pointed by Birks and Chin when they said, â€Å"Some jurists will still be attracted by the simplicity of the defendant-sided analysis, and they will point out, correctly, that the number of cases in which there is no unconscionable behaviour is very small†¦If there are two doctrines, there are two doctrines†¦The correct approach will be to treat both undue influence and duress as plaintiff-sided factors which ground relief based on a degree of impairment of the plaintiff's capacity to make decisions. † Even though they tend to separate the two doctrines, they still tend to relate it to duress. A new approach can be taken -that presents undue influence as a flexible doctrine- including the presence of flaws within the claimant and defendant oriented defi nitions.It can be said that undue influence can be both â€Å"excessive† (claimant-focused) and used in an â€Å"improper† or â€Å"unconscionable† manner (defendant-focused) depending on the facts of the case. Some of cases set under presumed undue influence had been miscategorised after directly applying the rules rather than interpreting the facts valuably. To prove that presumed undue influence has been exercised, the claimant has to establish â€Å"a relationship of trust and confidence† and consequently prove a â€Å"transaction that calls for an explanation. Scepticism is apparent, as shown by Lord Browne Wilkinson when he describes those certain relationships as â€Å"a matter of law [that] raise the presumption that undue influence has been exercised. † In other words, the relationship itself might give rise to a presumption of undue influence as applied under the two requirements. It should be observed each relationship should be interpr eted individually rather than being grouped into a certain type. If jurists apply the rules rigorously, they will only be; as Lord Nicholls refers to in Etridge, presuming that influence exists.Presumed undue influence taxonomy appears to have characteristics that divert undue influence from its essence meaning. It had been subdivided into firstly, â€Å"certain relationships as a matter of law raise the presumption that undue influence had been exercised,† and secondly, that â€Å"the complainant proves the existence of a relationship under which the complainant generally reposed trust and confidence in the wrongdoer. † Even if certain relationships do fall under the categories, they should not override the evidence set in the case facts that show whether undue influence has been exercised.It is supported by Lord Nicholls of Birkenhead when he says, â€Å"The types of relationship, such as parent and child, in which this principle falls to be applied, cannot be liste d exhaustively. Relationships are infinitely various†¦It would be absurd for the law to preserve that every gift by a child to a parent, or every transaction between a client and his solicitor or between a patient and his doctor, was brought about by undue influence. † Due to the flaws within their definitions, the subdivisions set under presumed undue influence would only aid in describing the various parameters of previous cases.However, once jurists intend to view them as firm rules that should be applied to any case that seems to relate to a certain criteria, they will be contradicting the overall idea that the doctrine is equitable. Flaws within the definition of actual undue influence caused it to overlap with other doctrines, hence emerging to misinform its overall implication. In Royal Bank of Scotland plc v Etridge , Lord Hobhouse defined it as â€Å"an equitable wrong committed by the dominant party against the other which makes it unconscionable for the domina nt party to enforce his legal rights against he other. † Also, Lord Nicholls emphasized that uncertainty builds up after subdividing the doctrine to actual undue influence, as it â€Å"compromises overt acts of improper pressure over or in such as unlawful threats. † Thus, it has â€Å"much overlap with the principle of duress as this principle has subsequently developed. † Flaws within the definition are evident, since it doesn’t seem to directly reflect a complete definition of undue influence that doesn’t overlap with other doctrines.Furthermore, in Bank of Credit and Commerce International SA v Aboody, the Court of Appeal dismissed the appeal because it had not been shown that the transactions were manifestly disadvantageous to Mrs. Aboody, because even though Mr. Aboody had unduly influenced her, he had not acted with any improper motive. It appears that the Court of Appeal; after recognising that the case is similar with others which had previ ously been classified as actual undue influence cases, had directly applied the rules set strictly under it without recognising that equity cases are variant and can be each judged valuably by their unique facts.The nature of the requirement â€Å"manifestly disadvantageous† was not used as its originator Lord Scarman had intended. This had been shown in the earlier case Bank of Credit and Commerce International SA v Aboody. â€Å"In a narrow sense, such a transaction plainly ‘manifestly' is disadvantageous to the wife. She undertakes a serious financial obligation, and in return she personally receives nothing. But that would be to a relationship of solicitor and client or medical advisor and patient, in the case of husband and wife there are intent reasons why such a transaction may well be for her benefit. The latter extract added the factor of â€Å"intention. † Intention appears to be a subjective matter that would be proven under the facts of a certain cas e, rather than applying the rules set under the categories of undue influence. Such cases therefore, â€Å"cannot be approached solely on a mathematical basis: it involves a value judgment. † This directly relates to the original nature of undue influence, where its flexibility should be granted rather than it being applied under regulations.The label â€Å"manifestly disadvantageous† should not be rejected, but only be set to clarify possibilities of what Lords may adopt in certain undue influence cases as Lord Scarman has proposed in National Westminster Bank Plc v Morgan. Overall, since it is a well vitiated concept known to be an equitable jurisdiction, courts should apply the doctrine of undue influence flexibly based on the facts of the case. There have been many subdivisions and titles that were set under undue influence. Firstly, arguments on whether undue influence is claimant-oriented or defendant-oriented.Secondly, divisions that are known as actual and pres umed undue influence (as well as subdivisions and requirements under them). Such criteria can be useful in describing the different parameters on what undue influence is generally all about. However, if the intention is to use it strictly to decide whether undue influence has been exercised or not, the flaws within their definitions might lead to misconceptions. Accordingly, returning to the basic definition that has been agreed upon would reduce the bewilderment and increase the possibilities that courts make correct jurisdictions. ——————————————- [ 2 ]. Primary education Essay

Education in its general sense is a form of learning in which knowledge, skills, and habits of a group of people are transferred from one generation to the next through teaching, training, research, or simply through autodidacticism. [1] Generally, it occurs through any experience that has a formative effect on the way one thinks, feels, or acts. Systems of schooling involve institutionalized teaching and learning in relation to a curriculum, which itself is established according to a predetermined purpose of the schools in the system. Schools systems were also based on people’s religion giving them different curricula. In formal education, a curriculum is the set of courses and their content offered at a school or university. As an idea, curriculum stems from the Latin word for race course, referring to the course of deeds and experiences through which children grow to become mature adults. A curriculum is prescriptive, and is based on a more general syllabus which merely specifies what topics must be understood and to what level to achieve a particular grade or standard. An academic discipline is a branch of knowledge which is formally taught, either at the university–or via some other such method. Each discipline usually has several sub-disciplines or branches, and distinguishing lines are often both arbitrary and ambiguous. Examples of broad areas of academic disciplines include the natural sciences, mathematics, computer science, social sciences, humanities and applied sciences. [5] Educational institutions may incorporate fine arts as part of K-12 grade curriculums or within majors at colleges and universities as electives. The various types of fine arts are music, dance, and theater. Preschool education is important because it can give a child the edge in a competitive world and education climate. Elementary schooling consists of five years of primary schooling and 3 years of upper primary schooling. Various states in the republic of India provide 12 years of compulsory school education based on national curriculum framework designed by the National Council of Educational Research and Training. Depending on the system, schools for this period, or a part of it, may be called secondary or high schools, gymnasiums, lyceums, middle schools, colleges, or vocational schools. The exact boundary between primary and secondary education also varies from country to country and even within them, but is generally around the seventh to the tenth year of schooling. Secondary education occurs mainly during the teenage years. In the United States, Canada and Australia primary and secondary education together are sometimes referred to as K-12 education, and in New Zealand Year 1–13 is used. The purpose of secondary education can be to give common knowledge, to prepare for higher education or to train directly in a profession. The emergence of secondary education in the United States did not happen until 1910, caused by the rise in big businesses and technological advances in factories (for instance, the emergence of electrification), that required skilled workers. In order to meet this new job demand, high schools were created, with a curriculum focused on practical job skills that would better  prepare students for white collar or skilled blue collar work. This proved to be beneficial for both employers and employees, for the improvement in human capital caused employees to become more efficient, which lowered costs for the employer, and skilled employees received a higher wage than employees with just primary educational attainment. In Europe, grammar schools or academies date from as early as the 16th century, in the form of public schools, fee-paying schools, or charitable educational foundations, which themselves have an even longer history.

Chechen militants had led the fight for emancipation, which allowed local movements to also plea their causes for separation from the Russian law. Militants engaged Russian authorities as they helped these local movements make a stand against the government, which led to the Second Chechen War (Tiersky & Jones, 2007). Goals of the group The goals/aims of the group were to create an independent state from Russian government/law, which would make them autonomous in their decision making and livelihood. Their means of achieving this autonomy came at a price as many Chechens died in the first and second wars, leaving tons more displaced. Emancipation being the central reason for their moveme nt, they have led attacks into Russia and other areas, which they feel that need to be emancipated from Russia’s laws. This group’s goals and aims have seen this group receive de facto independence for a short period, but this may not be the lasting solution the group is demanding (Schaefer, 2010). Support the group receives The media portrays the groups’ efforts without any bias. However, as with any war, there are some sympathizers. This is what propels the group to become relentless in their quest. Once the media relays different messages from the group to the public about its demands, wishes, and desires, it is next to impossible to predict the response that they may receive. Opponents and the government think that this is a means to attain the attention of the public to seek support in the group’s fruitless quest, which is to alienate their region from the rest of Russia. But in reality there wouldn’t be a difference in roads if the ban of texting while driving was enacted. In my opinion I don’t think texting while driving should be banned. I disagree with the whole concept of it. Banning texting while driving would be pointless, hard to enforce, and it isn’t the cause of increase in car accidents. One reason why texting while driving shouldn’t be banned is because it would be pointless. Drivers don’t only get distracted only by texting, but by many other things. As Balko stated in his article â€Å"There are countless other driver distractions that we’d never think of banning, from having kids in the back seat, to eating or drinking while driving to fumbling with the radio.† (Balko) The little things that people do while operating a vehicle can be more distracting than what people can imagine. Anything can happen on the roads when driving and at any time. Drivers would have to be more cautious when driving. Another reason why I disagree with the ban of texting while driving is because it isn’t possible to enforce this. In the article â€Å"Cities disagree on texting-driving ban† Ms. Gaff says â€Å"they ask ‘How can we enforce this?’† (Swartsell) Police officers will not know when a driver is texting. If banned, officers will just be given another reason to stop people. (Radley) They can’t just assume that drivers that are looking down are texting. This wouldn’t be fair to drivers. It wouldn’t make sense to be stopped based on an assumption an officer makes. Last, the increase on car accidents has nothing to do with texting while driving. In the article â€Å"Should Text Messaging While Driving Be Banned? No.† Radley states â€Å"Overall reported accidents since 1997 have dropped, too, from 6.7 million to 6 million.†Prople text and drive everyday and car accidents still decrease. Car accidents can happen depending on anything the driver is doing and or is focused on. Yes, some accidents may happen because of texting but it’s not a solid reason as to why it should be banned. Driver would just have to be more careful while texting and driving. Now I am aware as to why they would want to ban texting while driving. Car accidents that are done due to texting can be as frightening as to a drunken driving accident. Technology is taking over society, which causes so much agreement as to why they should ban texting while driving. But if they were to ban texting while driving, how does that guarantee anything to drivers? This would be exactly why I disagree with banning texting while driving. There would be no type of guarantee that if they ban this we’ll be safer. In the article â€Å"Should Text Messaging While Driving Be Banned? Yes.† McCarthy states â€Å"With the same fervor I had when I was first sworn into office in 1997, I seek common ground on issues I believe will make our country stronger and safer each and every day.† This doesn’t make me feel safe in no type of way. They are promising something to us that they have no control of. There would be no difference if texting while driving is banned or not. Pointless, hard to enforce and not causing the increase on car accidents are all reason why they shouldn’t ban texting while driving. There is no way anyone can make us feel safer if they ban texting while driving. That isn’t the only reason why car accidents are caused. So what if they ban texting while driving? Early Childhood Education Essay The access to a high-quality education has become a major issue for many developing school districts in the United States; more importantly, access to a high-quality early childhood education is even further limited to many families not just because of a lack of access, but because of a lack of resources in the United States public school system. Currently, early childhood education is not available for every student in the country and is not universally supported, but developing research around these young students has proven that an early childhood education will contribute to higher graduation percentages, reduced crime rates, higher  annual salaries, and an 8:1 return on economic dollar investment throughout their lifetime—thus producing high-quality citizens. Because of this, optional early childhood education programs should be funded at both the state and federal level and universally supported. Most often, early childhood education is targeted at three to five-year old children before entering elementary school, but many research studies and programs will identify early childhood care and education just as important for this age group as it is for children up to eight years of age. Programs for these children can be either school-based or center-based in urban or  rural areas (Early Education for All 2011). Each year between birth and the age of eight marks a time of exponential brain growth and helps to lay the foundation for subsequent learning and development. Since these years are marked by remarkable brain growth, early childhood is the prime age period for children to receive a quality education (National Education Association ! ROIGER! 2! 2014). It seems as if it is almost clear-cut, a quality early childhood education should be available to all children of the United States in order to help build future societal contributors. Spodek and Saracho’s book, Handbook of Research on the Education of Young Children, reaches beyond its title and touches on the theory and practice of early childhood education. The authors define these three areas as independent pieces in society’s perspectives, but interrelated in reality. Throughout history, early childhood education has been practiced for much longer than it has been researched. Until the last 50 years, when early childhood education became a hot topic in many funding debates, not a lot of researchers had initiated any studies. As early  childhood education development became more popular as a result of developmental psychology interest, Spodek and Saracho started to identify the chain of steps in expanding early childhood education in the United States and investment resources to train educators (Spodek and Saracho 2006). A major concern of early childhood education experts in the United States is the lack of funding, support, and resources available to allow these childcare programs to inhibit growth. In the past few months, funding has been difficult to obtain because of sequester cuts in federal  government funding, but it has been even more difficult to obtain state funding because of the lack of ability to borrow money at the state level or find new revenue. The support for early childhood education is currently limited because of the scarce information known to the public about this issue. Early childhood education is in fact a very bipartisan issue, despite more initiatives from liberal individuals to make these programs a reality. The trouble with supporting early childhood education programs is that most constituents are unaware of the impact it really  has on our society. ! ROIGER! 3! W. Steven Barnett of Rutgers University Center for Early Education explains early childhood education from his expertise in chapter one of School Reform Proposals: The Research Evidence. Children involved in the studies within the first chapter had a disadvantage compared to average students and were more likely to repeat a grade or fail a class. Research from the Child Parent Centers in Chicago sampled 1,500 children ages three to nine with extended elementary programs; the results that came back were more than reassuring. Students  who participated in the program were less likely to be placed in special education, repeat a grade level, or be placed under juvenile arrest. Additionally, these students placed higher on reading and math placement tests, and they also had a higher graduation rate compared to the other test groups. The research documented that achievement gaps were even better for this group if students were from high-poverty neighborhoods. Barnett supports early childhood education expanding to optional everyday schooling before kindergarten, and documents positive effects on a child’s long-term social and economic development. (Molnar and Barnett 2002). Soni Sangha, classified as a middle-class family member of New York City, wrote for a column in the New York Times about her struggles finding affordable access and availability to a public preschool program for her firstborn child. Sangha isn’t alone; several families are being rejected to a public school early childhood education because of lack of resources to educate all children in the state of New York. These families are being forced in a co-op early childhood education, which involves the active participation of parents providing facilities and materials to  a group of children at the lowest maintainable cost possible (Sangha 2011). While this method of education is certainly beneficial and better than no education at all for young children, Barnett’s optimal early childhood recommendations include trained professionals with bachelor degrees in the field educating these youth (Molnar and Barnett 2011). However, because Sangha’s family ! ROIGER! 4! didn’t have access to a public early education program, they had to settle for less than what they were hoping for. Art Rolnick is the senior fellow and co-director of the Human Capital Research  Collaborative in the University of Minnesotas Humphrey School of Public Affairs, as well as the former director of research at the Federal Reserve Bank in Minneapolis. Rolnick began his work in early childhood education almost on accident; he was recruited reluctantly to sit on the board for an early childhood organization known as Ready4K. Rolnick immediately saw the benefits of this early education, not just psychologically but also logistically (Schmickle 2012). As expert economists, fellow colleague Rob Grunewald and Rolnick discovered that high quality education  for disadvantaged young children created a 16% economic output with inflation-adjusted rates (Rolnick and Grunewald 2003). The facts played out over not just one longitudinal study but four longitudinal studies. Every study came back with consistent results: early childhood education is an unbeatable source of public investment. The capstone of these studies, known as the Perry Preschool study, found that every dollar invested in one particular underprivileged preschool program yielded over eight dollars in return. The same study again found lower arrests, higher  salary earnings, more graduations, and overall better learning achievements across the education system throughout elementary and secondary schooling (HighScope 2005). Early childhood education can make a significant impact almost right after birth if a particular individual demands it. For example, a CBS Denver newspaper highlighted Elle, who was a normal baby. However, once she turned 1 ? years old, she started to need more books, games, attention, and interaction. Her parents made a guilty decision of signing her up for two days of school each week even though she had the rest of her life to go to school. After several weeks in the program, the parents felt no remorse as Elle started to thrive in her classroom. Elle’s ! ROIGER! 5! parents later even described it as one of the best things they could have possibly done for Elle (CBS Denver 2013). This Denver toddler proved that early education could make an impact at the speed of which the brain develops, and the solution is to make sure every family has access to this training and development of children. Another concern that has recently been on the rise in early childhood education is retaining individuals to work in these childcare programs. Like any other teacher or care worker, low salaries don’t help to pay potential student loan payments among a host of other financial contributions. According to the Minnesota Department of Employment and Economic Development, pre-school teachers earn an average of $15. 74 per hour and childcare workers receive about $10. 50 per hour. Even bank tellers and janitors earn more money on average per hour than a childcare worker at $11. 91 and $11. 65, respectively. Because pay is low, demand is high. There are 28,422 childcare workers just in Minnesota and that number is expect to increase  by nearly 25% in the next decade (Regan 2013). Because of this demand, trained childcare workers and educators are needed in addition to financial support to make early childhood education a public reality for any family who wishes to enroll. Early childhood education is a growing trend in our society, and the access to it has become a growing issue. Funding is the best solution to this issue, but reform may also help play a major role in the future. Other states, for example, have started to allocate resources differently in their early learning programs. In 2005, Maryland appointed a director of early learning, whose  job was to clean up Marylands current early childhood education program and create sound efficiency. As a result of the appointed director, Maryland has helped 20,000 more children become ready for the first day of school (Maryland Department of Education 2014). The White House currently has many programs that focus on engagement of early learning, but the state of ! ROIGER! 6! Minnesota does not have many well-known programs that are specifically targeted for early learners. One of these programs through the White House is Race To The Top: Early Learning  Challenge, which allocates funds to states who are preparing their children for kindergarten more readily. Another very well known federal government early learning program is Head Start. Head Start programs give needy children the opportunity of receiving an early learning education. However, the program does not expand to every single need child in America, which creates many difficulties for all of the children who are in need of an early childhood education. Currently, the President is looking for ways to expand Head Start to more families in America. In  a time of economic crisis, the best way to deal with this problem from Head Start is through more funds. Both the Early Learning Challenge and Head Start have links at the state government level, but are largely projects of the national government. Minnesota needs to create a successful early childhood education environment in our state, and here is how we are going to do it. Experts recommend that the federal government quadruples funding for Early Head Start programs and maintain the level of funding on a yearly basis (Kagan and Reid 2009). There is no doubt that these programs cannot pay for themselves,  so the funds have to come from an alternative source besides the federal government. Minnesota’s cigarette tax recently increased from $1. 23 to $2. 83 per pack, and while this is one of the leading tobacco taxes in the country, it should be increased even further to total a tax of $3. 00 per pack. If the revenue from this increase were to be proportional to that of the most recent tax increase, the state would raise $223 million to invest into early childhood education programs (Hammersley 2013). ! ROIGER! 7! Even this simple solution would be an incredibly large increase in early childhood  education and childcare funding compared to the Ohio legislature, which passed measures of $30 million in additional funding for this fiscal year as a result of 2,100 child slots cut along with 307 staff jobs across the state due to sequestration. According to Gayle Kelly, executive director of the Minnesota Head Start Association, Minnesota will have 760 childcare positions in Head Start cut itself (Pew 2013). Imagine how $223 million in revenue from tobacco taxes could impact those 760 children, in addition to several thousand more. An additional opportunity to access funding for early childhood education programs is  putting the issue on a priority list compared to professional sports stadium construction and evaluating the best source of funding. This is one way that the public perception of early education programs might change and allow research to be initiated. Often times, the construction of huge entertainment attractions is viewed as an investment in economic development. However, early childhood education and childcare programs are also an economic investment. Because of one dollar invested into the program, eight dollars is turned back into the economy. This results from a higher standard of living due to a better job and a better  environment to grow up in compared to someone who might grow up in poverty. Not only are they an economic investment, but society also receives a social investment that entertainment complexes cannot reach. Early childhood educates builds better human beings by reducing crime rates, raising educational capacities, and preparing children to be future career workers. Early childhood education programs are very beneficial to our country. They are important because they contribute to the growth of well-rounded citizens who have active engagement in social, economical, and political engagements. The federal government has implemented programs, but they are also needed at the local and state level to have a larger ! ROIGER! 8! impact on these young children. Implementation of these programs, such as that of the Maryland coordinator, would help create an efficient early childhood education learning environment in Minnesota. Early childhood education is important because it fosters growth from birth until the age of eight years old, which is when 90% of the brain’s learning is developed. If children are to learn anything in their life, they must start to learn at the beginning of their lifetime. One child  from an early childhood education program could end up being soccer mom of the year in Manhattan or the first female president of the United State—but that will only happen if there is funding to help that child unlock her potential. ! Heavy Metal More Than Music Cultural Studies Essay Subcultures are present in all societies around the world. Their members usually differentiate themselves by clothing style, music or even behavior. Studies and theories of subcultures have been conducted by various sociological schools. The Birmingham School came up with three levels of general analysis in their theories about subcultures: structure, culture and biography (Stanley Cohen, Symbols of trouble, 1980). He viewed subcultures as a political battleground between the classes (p.50). The first level on analysis, structure, refers to the problems of society that cannot be controlled by individuals, it refers to constraints put on people by the distribution of power, the labor market or wealth. The culture represents the solution to all the problems imposed by the structure. The culture includes the responses of the people to the structure, responses based on traditions, ideologies. The culture represents the more broad form of group present. A subculture, as defined by Cohen, is the specific, especially symbolic form through which the subordinate group negotiates its position. Two dominant themes were defined. The first one represents the style, which constitutes a type of resistance to subordination encountered in most subcultures, for instance Punks, Rockers or Hippies. The second theme refers to the fact that the resistance by style becomes symbolic or magical for the people that are part of the subculture. The process of resistance is seen as a symbolic one in three contexts. The first circumstance is when the subculture attacks a target which is not connected to the source of the problem. The second circumstance is when the solution to the problem is seen as magical without any real chances of being fixed. The final form of symbolic meaning is represented by what the style stands for. The style can symbol something that is beyond the surface appearance. Common objects are borrowed and used as symbols of opposition and insubordination, often in an ironical way. Biography represents the third general level of analysis that can be distinguished in the new theories of subculture. It is defined as the pattern and sequence of personal circumstances through which the culture and structure are experienced (p 151). This refers to the symbolic meaning of a subculture and the way its followers actually live given that they are part of the subculture. Heavy Metal Subculture Heavy metal has become more than just a subgenre of rock or metal music. It has become a subculture that not only listens to bands that play heavy metal and attends concerts. Fans of this music embrace its style, way of thinking, behavior, language and symbolism. Heavy metal music appeared first in Birmingham with groups like Black Sabbath and Led Zeppelin. The unique sound of Black Sabbath was given by Tony Iommi, a factory worker that cut his fingers while handling a metal cutting machine thus being forced to wear plastic prosthetics on his fingers in order to be able to play the guitar. The background of the singers remained deeply integrated into their music and lyrics. However, defining songs as heavy metal remained a constant debate among metalheads. Defining the term strictly pushes fans to accept as heavy metal only songs that have a harsh, dark sound and include songs which have as a theme alienation and anger, traits which characterized the life of Black Sabbaths member, Toni Iommi. In contrast, defining the term heavy metal more loosely allows other bands to be included in this genre. These bands can have as their focus other themes, such as angry love, lost love, desired love and even partying. The lyrics of the songs are generall y focused on violence and angst, giving the songs a constant mood of anger and sorrow. Even if heavy metal has its roots in 1969, with the band Black Sabbath, it became a defined form, different from hard rock much later, in the early 1980s. This could be due to the approach of different instructors or because school curriculums are supposed to focus on the interesting facts and stories about slavery. The fact of the matter is there are some areas that go untouched when learning about slavery in most schools. Reading the book Black Southerners was something different for me. It was like some one opened a door and when I entered in I found hidden facts and knowledge about an institution that has a tremendous effect on my country and this history of race.   Ã‚  Ã‚  Ã‚  Ã‚  John B. As a structural theory, Functionalism sees social structure or the organisation of society as more important than individual. Functionalism is a top down theory. Individuals are born into society and become products of all the social influences around them as they are socialised by various institutions such as the family, education, media and religion. Functionalism sees society as a system; a set of interconnected parts which together form a whole. There is a relationship between all these parts and agents of socialisation and together they all contribute to the maintenance of society as a whole. Structural functionalism concentrates on the positive and negative functions of social structures. Societal functionalism is a particular type of structural functionalism that aims to explain the role of social structures and institutions in society, the relationship between these structures, and the manner in which these structures constrain the actions of individuals. According to structural functionalists, individuals have little to no control over the ways in which particular structures operate. Indeed, structural functionalists understand individuals in terms of social positions. It is not individuals who are ranked, but positions that are ranked according to the degree to which they contribute to the survival of society. High-ranking positions offer high rewards that make them worth an individual’s time and effort to occupy. The structural functionalist perspective also takes into account the concept of value consensus. Functionalists believe that society is held together by this consensus, or cohesion, in which members of the society agree upon, and work together to achieve, what is best for society as a whole. â€Å"The Identification † by Roger McGough Is a poem in which there is a Character for whom I feel sympathy. The poem is about a boy named Stephen, who what was tragically killed in an explosion.
